1. Acceptance of Terms

Welcome to Colorize AI ("Colorize AI", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our AI-powered photo colorization service available at https://colorize.ai (the "Service").

By creating an account, purchasing credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.

⚠️ Important: If you do not agree to these Terms, you may not use the Service. Continued use after any update constitutes acceptance of the revised Terms.

2. Description of Service

Colorize AI provides an AI-powered platform that transforms black and white photographs into colorized versions using deep learning models. This is a digital software-as-a-service (SaaS) product delivered over the internet.

The Service is a digital intangible product. Access is granted immediately after payment confirmation. Due to the immediate delivery nature of digital services, refunds are subject to specific limitations as outlined in Section 7.

3. AI Model Disclosure

The Colorize AI service utilizes third-party AI model providers including state-of-the-art image colorization models for generating colorized outputs. The specific models used may vary and are selected by us to provide optimal results. The performance and availability of the Service may be affected by these providers' operational status. Significant disruptions will be communicated to users promptly.

4. User Accounts

You must provide accurate and complete information when registering. You are responsible for maintaining the security of your account credentials and for all activities under your account.

Account Security:

• Immediately contact support@colorize.ai if you suspect unauthorized use
• Do not share login credentials with any third party
• Ensure your billing email address remains valid

If you register on behalf of a company or organization, you declare that you are authorized to enter into this agreement on their behalf.

5. Credit Packs and Payments

The Service uses a credit-based system. Credit packs can be purchased as one-time payments. Each credit may be used for one AI colorization operation depending on the model selected.

Credit Validity: Purchased credits are valid for 365 days from the date of purchase. Unused credits will expire after this period.

Authorization: Each credit purchase constitutes an authorized one-time transaction. By completing a purchase, you authorize Colorize AI to charge your payment method for the amount displayed at checkout.

Payment Processing: All payments are processed securely by Waffo Pancake, our payment service provider and Merchant of Record. We do not store your credit card details on our servers.

Taxes: Unless otherwise stated, prices do not include applicable taxes (including VAT, GST, sales tax, etc.).

6. Account Termination and Data Retention

If your account is terminated (whether by you or us), unused credits will be retained for 30 days following termination. After this period, unused credits will expire and will not be refunded unless required by applicable law.

Account data will be retained for 90 days following account cancellation, after which it will be deleted in accordance with our Privacy Policy.

7. Refund Policy

Consumed credits are generally non-refundable. The following exceptions apply:

• Unused credits within 7 days: Full refund if credits have not been used within 7 days of purchase
• Duplicate charges: Full refund for duplicate charges caused by billing errors
• Legal rights: Statutory withdrawal rights (e.g., 14-day cooling-off period for EU/UK) are preserved for first-time purchasers

To request a refund, email refunds@colorize.ai with your account email and transaction ID.

8. Billing Disputes

If you believe there is a billing error, please contact billing@colorize.ai before initiating a dispute with your bank. We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days.

9. AI Content and Intellectual Property

Your Content: You retain all rights to the photographs you upload.

Colorized Results: The AI-generated colorized output belongs to you. You may use the results for personal or commercial purposes consistent with these Terms.

Input Content License: By submitting content to the Service, you grant Colorize AI a limited, non-exclusive license solely for the purpose of providing the colorization service. We will not use your input content for training AI models without your explicit consent.

AI Output Accuracy: AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying output content before relying on it.

10. Acceptable Use Policy

You agree NOT to use Colorize AI to:

• Generate illegal, defamatory, harassing, or fraudulent content
• Generate, distribute, or assist in creating deepfake content, including AI-generated audio, video, or images that impersonate real individuals or are intended to mislead viewers about their source or authenticity
• Generate content involving the sexualization of minors or content that violates child protection laws
• Create malware, phishing content, or cyberattack tools
• Infringe on any third party's intellectual property or privacy rights
• Bypass or interfere with the Service's security features
• Resell or redistribute access to the Service without prior written approval
• Use AI-generated content to impersonate human professionals (such as licensed doctors, lawyers, or financial advisors) in potentially harmful contexts
• Violate any applicable laws, regulations, or card network rules

AI-Specific Prohibitions: In addition to the above, given the AI nature of this Service, you explicitly agree not to:

• Use the Service's input, output, model responses, or any derivative data to train, fine-tune, benchmark, knowledge-distill, or otherwise develop any AI or machine learning model that directly or indirectly competes with the Service or Colorize AI products
• Large-scale systematic scraping or collecting of model outputs for purposes beyond your personal authorized use

11. Data, Privacy, and Security

Your use of the Service is subject to our Privacy Policy, published at https://colorize.ai/privacy. Payment card data is processed exclusively by our PCI-DSS compliant payment processor (Waffo Pancake) and is not stored on our servers. Account data will be retained for 90 days after cancellation, after which it will be deleted.

12. Disclaimer and Limitation of Liability

As-Is Service: The Service is provided "as is" and "as available" without any express or implied warranties, including merchantability, fitness for a particular purpose, or AI output accuracy.

⚠️ AI Output Disclaimer: The Service's AI outputs may be inaccurate, incomplete, or outdated. Do not use them for legal, medical, financial, or other professional advice. Always verify with qualified professionals before acting on AI-generated content.

Liability Cap: To the maximum extent permitted by applicable law, Colorize AI shall not be liable for any indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Term and Termination

These Terms remain effective for the duration of your use of the Service. We may suspend or terminate your account if you materially breach these Terms, engage in suspected fraud, or if required by law. If we terminate the Service for reasons not attributable to your breach, we will pro-rate refund any prepaid unused portion. You may delete your account at any time by contacting support@colorize.ai.

14. Governing Law and Dispute Resolution

These Terms are governed by applicable law. Before initiating formal proceedings, please attempt to resolve issues informally by contacting legal@colorize.ai.

15. General Provisions

We may update these Terms at any time. Material changes will be communicated at least 14 days in advance via email. Continued use constitutes acceptance of revised Terms. If any provision is found invalid, the remaining provisions remain fully effective.
